1) Who we are
Berkerm LLC, a Wyoming Limited Liability Company, 30 N Gould St Ste R, Sheridan, WY 82801, USA ("Company", "we", "us") operates the DJ Berthiot platform at djberthiot.com.
2) Data we collect
- Account data: name, email, optional profile photo. Stored in Supabase.
- Payment data: processed by Stripe. We never see card credentials. We receive subscription status, plan, and transactional metadata only.
- Generation data: prompts, uploaded photos, generated outputs. Stored in Supabase Storage and processed by AI providers (see section 6).
- Chat history: conversations with your AI persona, stored to maintain context across sessions.
- Usage data: credits used, plan status, timestamps, technical diagnostics for reliability and support.
- Cookies & analytics: authentication cookies plus aggregate usage metrics via Google Analytics 4 (IP anonymized). Details and opt-out in our Cookie Policy.
3) How we use data
- To create and maintain your account and authenticate you.
- To process payments and manage subscriptions.
- To generate AI content from your prompts and uploads.
- To provide support.
- To maintain security, debug issues, and improve reliability.
- To send essential service communications (account, billing notices).
4) Where & how we store data
- Supabase: account info, generation metadata, chat history.
- Supabase Storage: uploaded photos, influencer avatars, and generated images, served via CDN.
- Stripe: payment processing; card data is not stored on our systems.
- Vercel: hosts our Next.js frontend (global edge network).
6) AI processing
When you generate an image, a video, or chat with your AI persona, your prompt (and where applicable, images you attach) is sent to one of our AI providers:
- Replicate — image generation (Nano Banana, Flux 1.1 Pro) and video generation (Kling v1.6).
- FAL — image generation fallback provider.
- DeepSeek — chat persona replies.
These providers process your data under their own terms. Their published API policies state that inputs sent via API are not used to train their models. We do not retain prompts or photos beyond what is necessary to deliver the Service.
Voice dictation uses Whisper ONNX running in your browser — audio never leaves your device and is not sent to any server, including ours.
7) Retention
- Account data is retained while your account remains active.
- Generated content remains in your account until you delete it or close your account.
- You may request deletion at any time; transactional records may be retained as required by law (e.g., tax/accounting).
8) Security
We use HTTPS, encrypted at-rest storage, row-level security in Supabase, and reasonable technical and organizational measures to protect data. No method of transmission or storage is 100% secure.
9) Your rights
Depending on your jurisdiction (EU/EEA, UK, California, China etc.), you may have rights of access, rectification, erasure, restriction, portability, and objection. To exercise these rights, contact us at besounder@gmail.com.
10) Children
The Service is not directed to children under 13 (or the higher age required by your jurisdiction). We do not knowingly collect data from children.
11) Changes to this policy
We may update this Policy periodically. Material changes will be reflected by updating the "Last updated" date.
