Privacy Policy

TL;DR

We collect only what's needed to run your account: name, email, usage logs. Payments go through Stripe and Alipay — we never see your card. Photos you upload are processed by AI providers (OpenAI, Replicate) and stored in Supabase. We don't sell your data, and you can request deletion anytime.

The legal entity (Berkerm LLC, Wyoming) is correct. Only [LEGAL_REPRESENTATIVE_NAME], [CONTACT_EMAIL] and [CONTACT_PHONE] remain placeholders. Replace them before publishing to production.

1) Who we are

Berkerm LLC, a Wyoming Limited Liability Company, 30 N Gould St Ste R, Sheridan, WY 82801, USA ("Company", "we", "us") operates the DJ Berthiot platform at djberthiot.com.

2) Data we collect

  • Account data: name, email, optional profile photo. Stored in Supabase.
  • Payment data: processed by Stripe and Alipay. We never see card or wallet credentials. We receive subscription status, plan, and transactional metadata only.
  • Generation data: prompts, uploaded photos, generated outputs. Stored in Supabase Storage and processed by AI providers (see section 6).
  • Chat history: conversations with your AI persona, stored to maintain context across sessions.
  • Usage data: credits used, plan status, timestamps, technical diagnostics for reliability and support.
  • Cookies: minimal first-party cookies for session management and authentication.

3) How we use data

  • To create and maintain your account and authenticate you.
  • To process payments and manage subscriptions.
  • To generate AI content from your prompts and uploads.
  • To provide support and operate workflows (n8n).
  • To maintain security, debug issues, and improve reliability.
  • To send essential service communications (account, billing notices).

4) Where & how we store data

  • Supabase: account info, generation metadata, chat history.
  • Supabase Storage: uploaded photos and generated images, served via CDN.
  • Stripe / Alipay: payment processing; card data is not stored on our systems.
  • Vultr: hosts our Flask backend and self-hosted n8n.
  • Vercel: hosts our Next.js frontend (global edge network).

5) Sharing of data

  • With Stripe and Alipay to process payments.
  • With OpenAI and Replicate to perform AI generation (see section 6).
  • With infrastructure providers (Supabase, Vercel, Vultr) necessary to operate the Service.
  • With authorities if required by law, regulation, or legal process.
  • We do not sell your personal data.

6) AI processing

When you generate an image, transform a photo, or chat with your AI persona, your prompt and (where applicable) uploaded image are sent to our AI providers — currently OpenAI (GPT-4, DALL·E 3) and Replicate (image transformation models).

These providers process your data under their own terms. We use API tiers that contractually prohibit using your inputs to train their models. We do not retain prompts or photos beyond what is necessary to deliver the Service.

7) Retention

  • Account data is retained while your account remains active.
  • Generated content remains in your account until you delete it or close your account.
  • You may request deletion at any time; transactional records may be retained as required by law (e.g., tax/accounting).

8) Security

We use HTTPS, encrypted at-rest storage, row-level security in Supabase, and reasonable technical and organizational measures to protect data. No method of transmission or storage is 100% secure.

9) Your rights

Depending on your jurisdiction (EU/EEA, UK, California, China etc.), you may have rights of access, rectification, erasure, restriction, portability, and objection. To exercise these rights, contact us at [CONTACT_EMAIL].

10) Children

The Service is not directed to children under 13 (or the higher age required by your jurisdiction). We do not knowingly collect data from children.

11) Changes to this policy

We may update this Policy periodically. Material changes will be reflected by updating the "Last updated" date.
